R. H. Childres III Law, LLC

Assisting probate courts as a court appointed attorney or guardian ad litem.

My primary focus is accepting appointments from local probate courts in guardianship/conservatorship and estate matters. In guardianship/conservatorship matters, I typically represent proposed wards as their court appointed attorney or make recommendations in the proposed ward's best interests as a guardian ad litem. In estate matters, I typically represent the interests of post-deceased heirs, unknown heirs, or unrepresented estates as a guardian ad litem. I also take guardian ad litem appointments on behalf of minors on Petitions to Compromise Doubtful Claim of Minor.

Practices Areas

At R. H. Childres III Law, LLC, we provide the following legal services.

Guardianships & Conservatorships

Individuals who are unable to make decisions on their own behalf or care for their wellbeing due to injury, illness, inability, or age may be protected by the legal processes of guardianships and conservatorships. When needed, the process may be fairly simple when all parties agree but may be much more complex when contested.

Probate Administration

Probate is the legal procedure where property and assets are transferred after a person's death. Whether or not there is a Last Will and Testament, obtaining counsel from a probate law attorney to assist in navigating the process can help create a smooth transition during an emotional and stressful time.

Professional Trustee or Executor

Often people wish to have a loved one or close friend serve as executor (the person who carries out the directives of a will) or trustee (the person who administers a trust according to its directives), depending on the complexity of your estate and your chosen beneficiaries, you may desire to use a professional fiduciary to safeguard the distribution of your assets, oversee business interests, and manage your investments.

Estate Planning

Estate planning involves planning for the distribution of your assets. Such planning can involve a will or the creation of a trust. Depending on your needs and the size of your estate, we may be able to assist you in drafting a will or providing you a recommendation for an attorney to assist in your estate planning.

Other Planning Tools

In addition to a will or trust, a financial power of attorney may assist with managing your assets during your life if you become incapacitated or need assistance. Likewise, an Advance Directive for Healthcare and a Georgia Psychiatric Advance Directive can assist with planning for your future medical care if you become incapacitated or unable to express your wishes.

Guardian ad Litem

I am also available to serve as a guardian ad litem on behalf of minors for settlements of lawsuits that have been filed in superior or state court where a Petition to Compromise Doubtful Claim of Minor will not be filed in probate court.
